Booking Terms, Conditions & General Information

Please read the following booking terms and conditions as they detail the contract with Firon Pty Ltd – trading as 318Africa (ABN 58 167 835 789). The signatory of the required booking form accepts these terms on behalf of all named in the booking and the words ‘client’, ‘you’ or ‘your’ in these conditions should be construed accordingly.

318Africa means Firon Pty Limited, t/a 318Africa ACN 167 835 789.
‘Conditions’ mean these terms and conditions.
‘Contract’ means an agreement for the provision of travel arrangements by 318Africa to the client.
‘Client’ means a person or persons booking travel arrangements with 318Africa.
‘Travel Arrangements’ mean the travel arrangements made by 318Africa.
‘Amendments’ means any change to the travel arrangements.
‘Products’ mean individual components of the travel arrangements, ie accommodation, meals, transportation, cruises and tours.
‘Services’ mean the booking and payment services provided by 318Africa.
‘Suppliers’ mean the third parties responsible for providing the individual products.
The conditions apply exclusively to every contract for services by 318Africa for the client. Confirmation of a booking, issuance of an invoice, payment of a deposit and signed booking form indicates the client’s agreement of the conditions and contract.
All quotations provided are based on current prices and subject to change prior to finalisation of the itinerary. All arrangements and prices are subject to availability at the time of booking, exchange rate fluctuation, or any other unforeseen changes beyond our control, ie National Park entry fees and local government taxes as these can be changed without notice.
A quote will be provided on request and will be valid for 7 days. Once a quote is accepted a provisional booking will be made. In order to confirm the booking, a deposit and signed booking form is required in order to proceed. A non-refundable deposit of 25% of the total cost is required per person travelling. On occasion some travel arrangements to certain destinations may impose a higher non-refundable deposit – please check with us at time of booking. Note any Gorilla and Chimp permits for tours in Rwanda or Uganda are to be paid in full at time of booking, as these can only be purchased once payment is received. As permit numbers are strictly controlled these are available on a first come first served basis with payment. Payment of deposit and a signed Booking Form represents acceptance of 318Africa’s Terms & Conditions. The final balance of payment must be received by 318Africa no later than 60 days prior to your departure from Australia. All bookings are held on a provisional basis until we receive the deposit. Once the deposit has been received a confirmation invoice will be issued. Any late booking requests for travel within 30 days must be paid in full immediately.
Any prices indicated on the 318Africa website or any marketing materials are either a ‘From’ price based on travelling at the lowest possible rate available at the time of promotion, or valid for a particular period if stated. All prices quoted are based on per person twin sharing cost in Australian Dollars unless otherwise specified and subject to change. Single or sole travellers may be surcharged with a supplement. Prices are subject to the quote provided. Travel arrangement prices are quoted for the entire package and itemised costs of the components cannot be given. Surcharges may be incurred (without limitation) in connection with currency exchange rates, increase in product prices, airfares, fuel levies, National Park and Conservancy entry fees and any other increases in connection with the travel arrangements. 318Africa cannot be held responsible for these surcharges and any subsequent change in total cost.
Once a booking has been confirmed, should any changes be requested and made, an amendment fee of $75 may be levied to cover administration costs. Should any additional charges be incurred by 318Africa these will be payable by the client. 318Africa reserves the right to change the itinerary should local conditions necessitate and substitute with products of an equivalent standard.
318Africa may treat a booking as cancelled and levy cancellation charges if the balance of payment is not received 60 days prior to the departure date. All cancellations must be received in writing and will take effect from the date received by 318Africa with the applicable cancellation charges as follows, although further cancellation charges may apply to some suppliers:

After you have commenced your travel arrangements, there can be no refund on unused arrangements. We recommend strongly that comprehensive travel insurance be taken out at the time of booking and payment of your deposit, to cover cancellation fees as well as medical expenses, loss of personal belongings or unforeseen expenses.

318Africa will not be held responsible or pay compensation where Force Majeure occurs, meaning unusual, unavoidable and unforeseeable circumstances beyond our control, including but not limited to war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, flood or adverse weather conditions.

318Africa acting as a booking agent for the suppliers of products, accepts no liability for any injury, loss, damage, accident, delay or irregularity that may arise to any client or third party resulting from the use of the products. 318Africa does not provide the products used and are not responsible for the third party supplier products or their standard.

Potentially any safari can have risks and it is essential that all directions and advice of the safari operator and their guides be followed. 318Africa selects the suppliers very carefully and will accept no responsibility for any illness, accident or loss whatsoever incurred in the course of the safari.

Visa Requirements – it is the client’s responsibility to ensure that all passports are valid with a minimum of six months remaining on returning home, with the possibility of denied airline boarding or entry into certain countries if not adhered to. Visas are required for Australian Passport holders for Tanzania, Rwanda, Kenya, Uganda, Zimbabwe, Zambia, Mozambique, Madagascar and Egypt. Many countries allow visas to be purchased on arrival with fees payable in US Dollars. Some countries also require a minimum number of blank pages in your passport. Clients travelling with minors under the age of 18 years of age to South Africa require an Unabridged Birth Certificate, and affidavit if minors travelling without both parents.

Medical Conditions – 318Africa must be advised of any pre-existing medical conditions that may affect the travel arrangements. It is the client’s responsibility to seek professional medical advice and obtain any vaccinations or oral medication necessary prior to departure. Please note that the Yellow Fever vaccine is compulsory for travel to East Africa and many other countries require proof of a valid vaccination card even in transit.

These conditions are governed by and are to be construed in accordance with the laws of the State of New South Wales and Australia. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Courts and Tribunal of New South Wales and Courts entitled to hear appeals from those Courts and Tribunals.

Any general information provided concerning passport, visa and health requirements are subject to change and the client is responsible for checking current requirements before departure. It is the client’s responsibility to ensure that they comply with all applicable requirements and takes all documents required for the trip. 318Africa will not be liable for any failure by the client to discharge these responsibilities and the client will have to reimburse the company for any costs it incurs as a result of such failure on the part of the client.
318Africa is the trading name of Firon Pty Ltd. We do our best to make sure your arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as a result of our negligence, or that of our employees. 318Africa uses third party suppliers and is not a provider of transportation, accommodation or touring services. The standards of accommodation and other services are based on various factors, which are generally accepted as indicated as a certain class, however we do not guarantee that standard or class for purposes of the accommodation or service. The client acknowledges and accepts that different countries, facilities and tour operators may have different standards of safety, warnings and precautions. The client is responsible for maintaining personal diligence and safety notwithstanding the level of standards. 318Africa is not liable for any loss, damage, injury or death that could be avoided if Australian standards were to apply.
